# Terms of Service

## 1\. Agreement to Terms

By using gardensuitetoronto.ca or engaging Garden Suite Toronto for any service, you agree to these terms and to all applicable laws of Ontario and Canada. Construction work is governed by the written contract we sign with you; if that contract conflicts with these terms, the contract wins.

## 2\. Our Services

## 3\. Website Information

Prices, timelines and by-law summaries on this website are general information for planning, current to the date shown. They are not a quote, legal advice or a guarantee of approval. Rules such as By-law 574-2022 and Zoning By-law 569-2013 can change, and the City of Toronto and other agencies make their own decisions on permits and approvals.

## 4\. Feasibility Reports and Quotes

Feasibility reports are prepared for your property only and are based on information available at the time of the site visit. We do not take a deposit for a feasibility report; the fee is due on delivery. Fixed-price quotes are valid for the period stated on the quote.

## 5\. Pricing and Payment

All prices are in Canadian dollars and exclude HST unless stated. Our standard terms are zero deposit on feasibility, 10% at contract, and five staged draws at permit, foundation, framing, finishes and occupancy. Payment is accepted by e-transfer, cheque or bank draft.

## 6\. Changes to the Work

Under a fixed-price contract, the price changes only through a written change order that you approve and sign before the work starts. We do not proceed with changes without your written approval.

## 7\. Permits and Approvals

We prepare and manage permit applications on your behalf. Review times and decisions belong to Toronto Building Division, the Committee of Adjustment, TRCA, Heritage Preservation Services, utilities and other agencies. Our 12 to 14 week figure is an average, not a guarantee.

## 8\. Cancellations

You may cancel a feasibility review before the site visit at no charge. Cancellation terms for design and construction are set out in your signed agreement and cover work completed and materials ordered up to the cancellation date.

## 9\. Warranty

Completed garden suites carry our written workmanship warranty: 10 years on structure, 2 years on finishes and 1 year on mechanical systems, transferable on resale, subject to the warranty document provided at handover. Tarion coverage applies where required by law.

## 10\. Limitation of Liability

To the extent permitted by law, Garden Suite Toronto is not liable for indirect, incidental or consequential damages arising from use of this website. Our liability for services is limited as set out in your signed contract.

## 11\. Intellectual Property

Website content, including text, graphics and logos, belongs to Garden Suite Toronto. Designs and drawings prepared for your project may be used for that property as set out in your design agreement.

## 12\. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
